Asset investigations for debt recovery

Inquiries into property holdings

Assets investigations are inquiries requested by creditors in order to reconstruct the debtor's assailable property. When this type of investigation is resorted to, it means that we are in a pathological stage of the relationship between creditor and debtor. That is to say, a stage in which the debt which the creditor hopes to collect has gone awry and there is very little likelihood of recovering it. In fact, when a significant amount of actions have already been performed (telephone reminders, notices to perform forwarded by e-mail and ordinary mail, etc.), which have been fruitless, the percentage of compliance by the debtor is objectively low.

In such cases, therefore, an investigation agency is called in in order to obtain information about the debtor, which will subsequently be indispensable in order to understand the feasibility or otherwise of forcibly recovering the amount owed. In fact, investigations of this type have the goal of reconstructing the debtor's assets in order to enable the creditor to attack him legitimately, by means of a court authorisation.

Such a service may prove necessary in all those circumstances in which, in addition to having to recover a debt, you no longer has any news about the debtor. Therefore, in addition to having to reconstruct the picture of the debtor’s income and assets (account relationships, employment, real estate owned, etc.), the debtor must also be traced. Hence, when planning investigations, even a single search may make it possible to trace the debtor.

Think of the identification of a debtor’s vehicle, which makes it possible to trace the residential address, so as to check whether the latter is still valid, or of a property in the debtor’s name, which makes it possible to obtain an important geographical reference to be taken into account in investigations, and so on. Starting from this data, more and more information about the debtor can be traced, which will eventually allow a good part of the assets to be reconstructed.

The asset investigation service thus makes it possible to obtain an indicative overview of the debtor's economic, asset and financial situation. This report will enable the professionals assisting the client to perform an analysis of the debtor's actual assets in order to assess whether or not it is advisable to proceed with any enforcement action against him.
